David Wemyss (1786-1840)

David died on the 26th of Jan 1840 at the age of 55. He left his estate to his childen John and Mina Wemyss but nothing to Munshoo, who is thought to be their mother. The estate of David was managed by a firm of solicitors and Munshoo received a monthly allowance of 12 rupees for John’s board plus other expenses as required. All the money was gone by March 1860.

Transcript of the will

In the goods of David Wemyss deceased, filled and probate granted to John Lawrie one of the executors reserving Power this 4th February 1840

In the name of God, Amen, I David Wemyss mariner at present residing in Calcutta being of sound and disposing mind, memory and understanding, but knowing that it is appoint for all men once to die, do this twenty second day of January in the year of our Lord one thousand eight hundred and forty make and publish this my last will and testament in manners and form following that is to say I desire to be dead interred at the discretion of my executors herein named.

And as to such worldly goods wherewith hath pleased God to bless me, whatsoever and wheresoever, whether real or personal, or of what nature kind or quality soever the same may be after paying of my just debts, funeral expenses, and the expenses of proving this my will.

I do hereby give, bequeath, and devise the same in the manners following. That is to say, I do hereby give, bequeath, and devise unto my son John Wemyss now residing at Howrah and to my daughter Mina(?) Wemyss the wholly of my property real and personal of what nature, kind or quality so ever the same may be in the manners following, Viz two thirds to my son John Wemyss and the remaining one third to my daughter Mina(?) Wemyss, the expends of which if not exceeding 10,000 rupees, ten thousand rupees, to be at the discretion of the executors for the maintenance and education of my son and daughter above named and further I should wish that my son John Wemyss as being yet a child should remain under the protection of his mother Munshoo(?) And I do hereby constitute and appoint my brother Mr John Wemyss residing in Edinburgh, collector of excise and Mr John Lawrie merchant residing in Cossitollah Calcutta of this my last will and testament, hereby revoking all former wills and testaments by me at any time heretofore made.

In witness, whereof I have to this my last will and testament set my hand and seal the day and year first above written.

Estate Accounts

The estate of David Wemyss was managed by a firm of solicitors, Messrs. Lawrie and Co. The estate was valued at 4,783 rupees.

The estate was divided as follows:

  • John Wemyss (2/3rd) 3,188 rupees
  • Mina Wemyss (1/3rd) 1,595 rupees
  • Munshoo (John's mother) nothing
Munshoo received a monthly allowance of 12 rupees for John's board plus other expenses as required. All the money was spent by March 1860.
